Luke Allan, 30, of Barham Avenue, Warrnambool, pleaded guilty in the Warrnambool Magistrates Court yesterday to a range of offences, including trafficking, possessing and using ice.
Allan was convicted, jailed for two months and on release will be on a 15-month community corrections order involving 120 hours’ community work, treatment and assessment for drugs issues.
The jail sentence will be minus the 14 days he has already spent in custody.
Police intercepted Allan at 1.50am on February 27 in Warrnambool’s Fairy Street and found a zip-lock bag containing 1.5g of ice in a cigarette packet.
Allan denied using or possessing crystal methamphetamine, even though the substance found spot tested positive to ice.
He was charged and bailed.
Then on April 17 a member of the Warrnambool police highway patrol unit intercepted Allan driving a white Toyota ute in McGregors Road.
Allan refused to undertake a driver drug test and because of a prior alcohol driving offence his licence was immediately suspended.
The police officer also found $1045 cash and a tick list detailing drug transactions.
Warrnambool police divisional response unit (DRU) officers were at the time investigating Allan after the arrest of an associate on April 11.
Texts messages between them related to drugs.
The DRU officers conducted an additional search of Allan’s vehicle, uncovering digital scales, an iPad which contained video clips of Allan smoking what appeared to be ice, three deal bags in a mints container and eight ecstasy tablets.
Allan was arrested and moved into the police station cells. He was then found to have an ice smoking pipe and 21g of ice with a street value of $21,000 in his underwear.
Defence counsel Belinda Northey said Allan’s most recent prior offending was a local laws breach in 2006.
She said her client had been using ice for six months and transitioned from a user to trafficker to fund his addiction after he lost his job in February.
Police prosecutor Senior Constable Kevin Mullins said 21g was about as much as any local dealer had been caught with and it was clear Allan was heavily involved in the Warrnambool drug scene.
Magistrate John Lesser said to say the use and distribution of ice was a significant problem for cities like Warrnambool would be an understatement.
