Dylan Gubecka, 29, of Nicholson Street, pleaded guilty in the Warrnambool Magistrates Court this week to recklessly causing injury.

He was convicted, fined $1000 and jailed for one month, which was suspended for 12 months.

Police said that Gubecka and a woman had been in a relationship for four months but there were signs of problems.

On July 26 this year Gubecka went to a 21st birthday celebration by himself. The woman stayed at home and told him not to return home.

Early the next morning when Gubecka came home drunk he yelled at and scared the woman, who fled out the back door.

She attempted to climb a back fence and Gubecka tried to pull her back, but when he couldn’t he pushed her over it.

The woman went to the front of their unit and Gubecka grabbed her around the throat. 

He was extremely violent and held her down by the throat, preventing her from running away.

When he let her go she ran off but Gubecka chased her and dragged her back into the unit. 

She got another chance to break away, fled out the front door and down the street from where she called police.

During an interview with police Gubecka said his actions came out of pure frustration over the relationship which was going nowhere.

Magistrate John Lesser told Gubecka there was no excuse for his behaviour and he had messed up in a similar manner in the past.

He said it was appropriate Gubecka undertook a men’s behaviour change program.

“It’s important you do not come back to court again,” the magistrate warned Gubecka.
