The Victorian Civil and Administrative Tribunal (VCAT) upheld a decision by Moyne Shire to deny developers subdivision rights in Thistle Place.
Justice Geoffrey Code said the proposal had to be rejected as it covered both rural living and residential zones.
Moyne Shire is still preparing the Port Fairy West Structure Plan, which will place in clear terms what can and can’t be built in the area.
