CONTINUALLY breaching a driver’s licence alcohol interlock device condition has landed a Warrnambool man in jail for four months.

Tim Benson, 24, of Glenrowe Avenue, pleaded guilty in the Warrnambool Magistrates Court to a string of driving charges, the most serious being repeatedly driving without an interlock fitted to his vehicles.
Benson was caught by police driving six times between August last year and January this year. He was intercepted in a number of cars which did not have an alcohol interlock device fitted.
He was also caught with capsicum spray and was regularly found not displaying P-plates or carrying his licence, driving a manual in breach of his licence conditions and driving an unregistered car which was carrying false plates.
That offending breached a three-month jail sentence imposed in November 2012.
Benson will also appear in the next sitting of the County Court in Warrnambool starting March 24 for unpaid fines.
On top of that he faces breaching another two-month suspended sentence imposed in the County Court in January last year and the magistrates court heard this week police caught Benson driving again last weekend. Defence counsel Xavier Farrelly said his client’s car was off the road when the offending occurred and he drove other vehicles which were not fitted with an alcohol interlock.
Magistrate Peter Mellas said because of the defendant’s poor driving history there had to be consequences and Benson would be going to jail.
He said Benson had to either only drive a vehicle with an interlock fitted or simply not drive.
Benson was convicted, fined $1000 and jailed for one month. The previously suspended three-month sentence will also have to be served.
