Timothy Gabriel, 40, previously of Whites Road, pleaded guilty in Warrnambool Magistrates Court on Monday to unlawful assault.

The court heard that on February 11 last year, Gabriel was using a Commonwealth Bank ATM located on Warrnambool's Liebig Street shortly before 8am.

The victim, a Warrnambool City Council worker, was nearby using a leaf blower to blow dust and debris from the footpath and onto the road in order to be collected by a sweeping machine.

The court heard Gabriel became enraged as he believed the victim was blowing dust onto his Ford Falcon sedan.

He yelled three times at the victim, who could not hear because he was wearing ear muffs.

Gabriel swore at the victim who eventually took the ear muffs off.

He then told the victim that if he didn't stop he would "put a shotgun in your face".

The victim told the man it wasn't a good idea to make such threats, in which Gabriel replied: "I'll shoot anyone I want".

The incident was observed by a civilian witness.

Gabriel was interviewed by police on April 26 last year.

On Monday he was convicted and fined $350.
