Jason Lee Clark, 40, of Warrumyea Road, appeared in the Warrnambool Magistrates Court for what was meant to be a guilty plea hearing.
Defence counsel Damien Pitts said that an assessment had been done on a different Jason Clark.
Magistrate Cynthia Toose said what had happened was very regrettable, the clinician involved was extremely embarrassed and this had never happened before.
Mr Pitts said the assessment would now be fast-tracked and another plea hearing date had been scheduled for May 18.
Ms Toose told Mr Clark that his current time in custody would be taken from any jail sentence imposed.
Mr Clark said the events were "sad" but that he was comfortable.
"I'm fine, I'm just fine," he said, adding that he hoped 38 days he had spent in lock down at Port Phillip Prison, due to a fire, was also taken into account in sentencing.
Mr Clark is on a range of charges and expected to receive a jail term.
