The Victorian Civil and Administrative Tribunal is expected to make a ruling in September on whether to allow a home to be built on 107 Gipps Street.
Moyne’s sustainable development director Oliver Moles said the tribunal would determine whether to uphold council’s decision not to grant a building permit to applicant John Mugavin to build a home on the site next to the Moyne River bridge.
Mr Mugavin acquired the land freely under an adverse possession claim two years ago.
