A MOTORCYCLIST who tested positive for methamphetamines after being involved in a road accident has avoided jail.
Simon McCall, 33, of Janlor Court, pleaded guilty in Warrnambool Magistrates Court yesterday to driving while disqualified and failing a drug blood test three hours after riding.
The court heard that on Thursday, February 9, McCall was riding a Honda motorbike north along Fairy Street towards Timor Street.
He was travelling behind a Peugeot sedan when it turned right and knocked McCall off his motorbike.
He was taken to Warrnambool Base Hospital and suffered serious leg injuries and later tested positive for methamphetamine and cannabis.
McCall was disqualified from driving at the time and when interviewed by police he said he didn’t think the crash was his fault.
In May McCall had a six-month prison term in the community altered to a suspended jail sentence after being involved in the road accident.
In November last year he pleaded guilty in Warrnambool Magistrates Court to recklessly causing injury, possessing a controlled weapon, driving while suspended and two counts of assault with a weapon.
At the time McCall was convicted and fined $1000 and handed a six-month intensive corrections order (ICO).
Magistrate Jonathan Klestadt heard McCall had gone through upheaval in his life following the breakdown in his marriage.
The court heard McCall had not used drugs since the incident and had begun a cooking course.
Mr Klestadt said he’d heard before that McCall had gone through a change of circumstances and that his court appearance was a wake-up call.
He said although the collision was not McCall’s fault, he had chosen to use illicit substances.
McCall was convicted and fined $1000 and disqualified from driving for another nine months.
