Mark Van Der Zant, 45, and his victim met while out drinking with their respective colleagues at a Melbourne hotel in July 2013, the County Court heard on Thursday. The two groups of friends met at the bar and sat at the same table.

Later, the woman, who was then 20, woke up to find herself naked with Van Der Zant on top of her, holding her arms over her head. She was unable to speak. After he raped her he invited her to stay and offered to book her a taxi if she wanted to leave, the court heard.

The father-of-two has maintained his innocence, unsuccessfully arguing at two trials that she consented to having sex with him. He was previously sentenced but a retrial was ordered after he successfully appealed the verdict.

Judge Michael Tinney said that Van Der Zant, who was married and previously had a successful career, "had it all" but had "fallen from grace" in raping the woman.

Judge Tinney questioned how someone who was comatose and vomiting could suddenly find a "spring in her step" to enthusiastically have sex with a stranger, and then leave the hotel in the early hours of the morning.

Van Der Zant's version of events, including that the woman helped him take her own clothes off before having sex with him, "beggared belief", the judge said.

"Any right-minded person" who saw the CCTV footage of the state she was in at the time would doubt this happened, he said.

"[You] took the opportunity presented by her obviously vulnerable state to have sex with her for your own release," the judge said, and imposed the same sentence of five years, nine months imprisonment, with a non-parole period of three and a half years.

The woman became so drunk that night that she could not stand or tell her friends her address, so they decided to put her in one of Van Der Zant's colleague's bedrooms rather than sending her home in a taxi, the court heard.

She was later taken to Van Der Zant's room, where she slept, fully clothed, as her friends left and her supervisor began having consensual sex with Van Der Zant.

Just before 4am, the supervisor left the room to book a taxi for herself and the woman, but did not have a key to get back into the hotel room, leaving Van Der Zant and the victim alone.

The victim, who was in court on Thursday, moved overseas after the rape and initial trial.

She has lost trust in others, suffers constant nightmares and fears she will remain alone because she feels "forever damaged" by the crime, the court heard.

The judge said that character references for Van Der Zant which referred to the respect he had for women contrasted with the fact he had cheated on his wife in the presence of his victim.

He had shown no genuine remorse, despite writing a recent letter of apology to the victim since he was found guilty earlier this year.

Remorse was not the same as self-pity, or his feelings of shame at the impact his imprisonment would have on his children, Judge Tinney said.

The court heard Van Der Zant's sons believe their father - who has been in jail for more than a year - is away for work.
