Drink-driver Timothy Wood was convicted, fined $564, his driver’s licence was cancelled for 15 months and he was placed on a 15-month community corrections order.
A REPEAT offender who pleaded guilty to three counts of driving while suspended and a charge of drink-driving has been given a community order after spending 38 days in custody.
Timothy Wood, 24, pleaded guilty in Warrnambool Magistrates Court and magistrate Ann McGarvie decided to have Wood assessed for a community corrections order.
She said that after spending time in custody, where he was seriously assaulted, if Wood was ever going to change his life now was the opportunity.
Ms McGarvie said she hoped the 15-month community corrections order would assist with Wood’s housing, employment, treatment and help him stop using drugs.
Wood was convicted, fined $564, his driver’s licence was cancelled for 15 months and he was placed on a 15-month CCO with the conditions he do 200 hours’ work and undertake assessment and treatment as required.
Wood previously served an intensive corrections order for similar offending.
Defence counsel Pat McComish said his client had completed his 100 hours’ community work previously imposed but the solicitor admitted that Wood generally did not help himself.
He said he had a sense of deja vu after standing in front of another magistrate last year.
“He’s worth another crack at it,” Mr McComish told the magistrate yesterday.
Police alleged that Wood lost his driver’s licence for demerit points in August last year.
Wood was caught driving in Warrnambool along the Hamilton Highway in mid November. When he talked to police Wood said he had got his licence back after paying $50.
On December 20 Wood was charged with drink-driving after being intercepted along Tozer Road.
He attempted to undertake a preliminary breath test four times before recording a positive reading and then an evidentiary reading of .048.
As a P-plater his licence was immediately suspended. Wood was then caught by police driving on January 13 and January 21, once he was speeding at 81km/h in a 70km/h zone and went through a stop sign.
