A WARRNAMBOOL drug trafficker again caught with ice and drug paraphernalia in her home has been given a chance to avoid an immediate jail term.

Simone Proctor, 35, of Menzies Street, pleaded guilty in the Koori division of the Warrnambool Magistrates Court to possessing both crystal methamphetamine (ice) and prescription medication and breaching a six-month suspended jail sentence.
Police executed a search warrant at Proctor’s home at 11.30am on August 12 last year and found deal bags, digital scales, a small straw, a Diazepam tablet and about 0.4 grams of white crystal powder believed to be ice.
During the search Proctor showed police where ice was hidden under the top of a hockey table.
In February last year Proctor received a 10-month jail sentence for trafficking ice, with four months to be served immediately and the remaining six months suspended for 18 months.
Defence counsel Amanda Chambers submitted there were exceptional circumstances which would allow Proctor to avoid serving the suspended term. She said her client had been charged with possessing ice and not trafficking ice, which was a far more serious charge.
Ms Chambers said Proctor had no other criminal charges pending, was now in a stable relationship and did not know who owned the ice found by police.
The court heard the ice could have belonged to Proctor’s brother Michael, who was sentenced to 12 months’ jail in early December last year. Magistrate Peter Mellas decided to defer sentencing for Proctor until September 17 after the expiry of her suspended jail sentence.
If she does not offend again the suspended sentence is unlikely to be activated, he said.
