John Williams, 46, of Coleman Lane, Warrnambool, was caught on January 21 with a blood-alcohol level of .140.
This week in the Warrnambool Magistrates Court he lost his licence for 14 months and was fined $1500 for the offence.
Williams had been driving home after a work dinner that was followed by drinks.
Magistrate John Lesser said the question of imposing a conviction on Williams arose because it was his third time before the court on various matters.
However, he said it was 10 years since Williams’ previous appearance and he would not record a conviction against him.
