A HAMILTON man has abandoned an appeal in the Warrnambool County Court after being told he could be sent to jail.
Wesley Harold, 42, had appealed against the severity of a six-month suspended jail term he received on September 4 for mainly street offences, including unlawful assault, intentionally damaging property, using cannabis and behaving in an offensive manner.
Defence counsel Shane Kennedy told Judge James Montgomery that the jail term suspension period of 24 months was setting up his client to fail.
Judge Montgomery replied that was only the case if Harold reoffended.
He warned Mr Kennedy his client risked immediate imprisonment if they proceeded with the appeal.
“He’s lucky he’s not in jail,” the judge said.
When told Harold was 42 years old, Judge Montgomery said it was time Harold stopped offending.
After a brief discussion Mr Kennedy abandoned the appeal on behalf of his client.
