A PROSPECTIVE wedding involving two Warrnambool people in a long-running, dysfunctional relationship could help a man get out of custody.
Kevin Timothy Knowles, 41, of Suzanne Crescent, appeared in Warrnambool Magistrates Court last week to apply for bail. It was refused and he was remanded in custody until October 25.
Mr Knowles had applied to vary an intervention order between himself and a woman so they could have contact but he failed to show up in court on October 3.
Another application to vary the order has now been made and is expected to be heard on October 25. Mr Knowles said he and the woman wanted the order changed so they could get married.
Magistrate Jonathan Klestadt said that the attitude of the woman towards Mr Knowles could prove to be new facts and circumstances which may allow Mr Knowles to be released on bail.
He instructed police to find out the attitude of the woman towards the IVO being varied.
Mr Knowles was arrested and refused bail on October 4 after allegedly breaching the intervention order.
Police allege Mr Knowles and the woman spent a night together in Port Campbell despite the order, there was an argument between them and police were called.
Police are preparing three briefs of evidence against Mr Knowles and last month he was placed on a four-month community corrections order for driving offences.
Most of the charges Mr Knowles is facing relate to his on-again, off-again partner.
Constable Rob Wilson told court Mr Knowles had booked into a Port Campbell holiday park for three days.
It is alleged that on September 28 the woman went to a park staff member and complained she had no money to get back to Warrnambool.
She is alleged to have said she was with Mr Knowles, they had been drinking, argued and she hit him with a kettle to the face.
Constable Wilson said police were concerned that if released on bail Mr Knowles would continue to offend, interfere with witnesses and possibly assault the woman.
Mr Knowles said he went to the Port Campbell motel by himself and refused to let the woman into his room.
“I still don’t know why I’m in custody. I kicked her out of the motel room where I was staying because of the intervention order,” he said.
Mr Knowles said he would contest charges being laid against him.
