A PORT Fairy man accused of continuing to pester his former partner even after being arrested and released on bail has been jailed for three months.
Billy-Joe Heard, 34, of Griffiths Street, pleaded guilty yesterday in Warrnambool Magistrates Court to a number of charges after being given a sentence indication in a contest mention hearing.
He was sentenced to serve one month on top of a restored two-month jail sentence with a further two months’ imprisonment suspended for two years. He will serve a minimum three months in jail.
Heard was originally charged with numerous offences in three briefs of police evidence.
Police alleged that on June 26 this year Heard was released on bail, but he then contacted his former partner by telephone the next day.
On June 28 he contacted her again and asked her to drop charges but she refused.
Police allege that on June 29 and 30 Heard stayed with the woman overnight.
Police also alleged that in February this year Heard and a friend went to a Henna Street caravan park unit where they met a friend who was a resident.
The trio went and bought two slabs of beer and they began drinking.
Heard and his friend damaged a ceiling fan, fridge door and used a fire extinguisher, causing $1785.70 damage.
It was suggested a thong was put in a microwave and the fire extinguisher was used to put out a fire. Heard was ordered to pay compensation.
On June 25 police also alleged Heard went to his former partner’s Port Fairy home to collect a bankcard. He was told there was no credit on the card and he demanded the woman give him cash, which she refused.
The woman’s brother came out and there was a scuffle between the men, during which Heard scratched the brother’s arm, neck and chest.
The woman’s mother turned the garden hose on Heard in an attempt to get him to go away. He left yelling abuse, threatening to kill the brother and damage his car.
Heard has appealed against the severity of the jail sentence but is expected to drop the appeal and serve his three months once he gets his affairs in order.
